Alabama’s new immigration law
DU: No water or power for illegal immigrants

Decatur Utilities now prohibits illegal immigrants from obtaining electric, gas, water or sewer service, an official said Friday.

Stephen Pirkle, DU business manager and chief financial officer, said DU previously required residents seeking utilities to provide identification, but their immigration status was not relevant.

“We did not document or confirm whether or not they were citizens or aliens here legally,” Pirkle said. “Because of the new law, we are now going through the process to confirm that they are either a citizen or an alien here legally.

“If not, we will deny them service.”

In seeking a ruling that the immigration law was unconstitutional, the U.S. Department of Justice claimed that Section 30 would prevent illegal immigrants from obtaining power and water service.

State Attorney General Luther Strange argued in a legal brief he filed in August that the Justice Department’s claim was “misinterpreting, or at least exaggerating” the requirements of the law.

“Its fear that Section 30 would prohibit such aliens from having running water or sewer services, for example, has little basis,” Strange wrote.

Section 30 makes it a felony for illegal immigrants to transact business with the state or its subdivisions.

In the brief, Strange said many utilities are not subdivisions of the state and not subject to Section 30.

Pirkle said DU began imposing the requirement in the last two weeks, but he is not aware that anyone has been denied service based on immigration status.

He said it is not always clear whether a person is an undocumented immigrant or simply failed to bring necessary identification to apply for service.

Pirkle said DU is only requiring documentation of legal immigrant status for individuals and partnerships beginning new service, adding an account to existing service or attempting to restore service after it has been shut off for nonpayment.

“If you’re already a customer and you already have service with us — and there’s no discontinuation of service — we don’t have to do anything,” Pirkle said.

Section 30 of the Beason-Hammon Alabama Taxpayer and Citizen Protection Act requires the state and its political subdivisions to confirm that individuals conducting “business transactions” — which the law defines to mean “any transaction” — are legally present in the United States.

The law makes it a felony for a legal resident to enter into a transaction with the state or its subdivisions on behalf of an undocumented immigrant.

State Rep. Micky Hammon, R-Decatur, the House sponsor of the law, applauded DU for taking the step.

“Our goal was to prevent any business transactions with any governments. It’s just an extension of the goal of the entire bill — to prevent illegal immigrants from coming to Alabama and to discourage those that are here from putting down roots,” Hammon said.

He said he is pleased with the results.

“It seems to be working,” Hammon said. “We’re seeing a lot of illegal immigrants self-deport.”

Hammon said legal residents also need to pay attention to the law.

Conspiracy clause

“We have a conspiracy clause in there,” Hammon said. “Anybody who assists illegal immigrants through any of these processes will also be guilty of a felony.”

In a September decision blocking enforcement of some portions of the law, federal District Judge Sharon Blackburn did not block Section 30. Blackburn said the language of the section was confusing, but she concluded the section at least applied to commercial contracts and licenses. She did not address whether the provision applied to utilities.

Barney Lovelace, a Decatur lawyer who gave a seminar on the immigration law Friday, said he believes both DU and Hartselle Utilities must require documentation of a customer’s immigration status.

“In my opinion, Decatur Utilities and Hartselle Utilities would be considered political subdivisions, as referenced in the act, and would be subject to Section 30,” Lovelace said.

DU’s decision to require the documentation was based on a legal opinion issued to Electric Cities of Alabama, a coalition of the state’s municipally owned electric utilities. Pirkle said DU did not consult with the state attorney general on the issue.

Other municipal utilities in the region include those in Athens, Courtland, Cullman, Huntsville, Russellville and Scottsboro. All are members of Electric Cities, and Pirkle said it was his understanding that all Electric Cities members are now denying new or restored service to illegal immigrants.

Alabama’s 36 municipal utilities serve a million customers, according to the Electric Cities website.

Same in Huntsville

Huntsville Utilities also has instituted a policy of denying service to illegal immigrants, said Bill Yell, its communications director. He said the utility serves about 164,000 customers.

If prospective customers lack the documents necessary to confirm authorized immigration status, “we can’t give the service, by law,” Yell said.

Representatives of Hartselle Utilities and Athens Utilities did not immediately return calls Friday.

DU plans to require documentation from U.S. citizens only once.

“They won’t have to do that every time they transact business,” Pirkle said. “For aliens who are here legally, we’ll have to continue to verify on an ongoing basis, to make sure the reason they are here has not expired.”

The human toll of the policy could be devastating, said Stephen Stetson, a policy analyst for Alabama Arise. He heard about DU’s policy Saturday while listening to a radio station playing Christmas music.

“I’m listening to these songs about charity and compassion,” Stetson said. “It struck me as a cruel and ironic policy as we head into the coldest months of the year.”

Ripple effect?

He feared a ripple effect from the policy.

“People who have their power cut off are going to be among the most disadvantaged,” he said. “It’s kicking them when they are down.”

He worried about the health ramifications of the policy and the impact it would have on immigrants’ ability to care for their children, many of whom are U.S. citizens.

Opponents of the law see it as self-evident that the element of human tragedy is a sign the law is defective. They need to remember the law’s supporters see it differently,” Stetson said. “It’s designed to make life more difficult. By destroying households and families, it’s doing that.”

I glad I'm not a Mexican. Deciding what is best for their family would suck.

Perhaps you should rephrase that Robert: "I'm glad I'm not in this country illegally..."

The state of Alabama is intent on destroying households and families, immigrant's children are U.S. Citizens and they are being deprived of their Constitutional rights.

I'd like to see Hammon and Beason go live in a hole in the ground with our military in Iraq, only then will they appreciate what our Constitution stands for, which BTW they took an oath to uphold.

Those who have chosen to enter this country illegally have placed their children in jeopardy. Anchor babies should not exist, but for a perversion of the intent of the 14th amendment.

Yeah or Maybe No, illegal children are not U.S. citizens, and do not receive constitutional rights. Yeah or Maybe No, Hammon and Beason must feel like, "thorns stuck in your big toe."

@ Kerry, that argument you will have to take up with the Supreme Court of the United States. For it is that Court that opined Children born in America are U.S. citizens regardless of the status of their parents.

Why feel sorry for theillegals, they can enter legally & we should have no issuws. As far as children born after the arrival of the illegal parents, that is absurd. Why do you think they procreate after coming here? So we will give the a break, I am sorry but illegal is illegal. Where were all of these nasty comments before the law came into effect. ? I bet none of you have ever done anything illegal have you. Thrown trash out of your car, had an open bottle, smoked where prohibited, driven over the speed limit, not using your seat belt, etc,etc,etc. Guess the grocery stores will stop selling them food pretty soon too, then you can all be happy.

If you believe that HB 56 was supported by legislative members because they believed it would rid the State of illegal aliens and improve the lives of the general Alabama public, you're sore from that fall off of the turnip truck.

A family from out-of-state looking a the Daily would think Decatur is a slum city full of criminals. Such a contrast to the Huntsville paper, which often features the legal, educated physicians and engineers who have worked through the arduous process to become proud Americans with skills and abilities sought after by their new community.

The children of illegal aliens from Mexico may have the right to return to the United States as adults, but they also have the right to return to Mexico with their Mexican parents. Their parents do not have the right to stay here are rear them, nor can the parents legally abandon them.

One day we will be embarrassed by these actions. This period will be placed beside the Trail of Tears and the hosing down and beating negroes under the direction of Bull Connors, in our history books. Ironically the Hammon's were involved in the history that took place in the 60's.

I like Yeah & Maybe No using the law as a means of justification of anchor babies, but ignores the law concerning ILLEGAL MEXICANS. HB 56 IS working!

@Ted law is law. justification doesn't matter. Your law violates the Constitution, period. Your law is King's law, that is why the Constitution was mandated. Upper federal courts will rip your law apart declaring it unconstitutional.

Why Alabama doesn't think it has to honor federal con law is baffling, but Alabama has always been that way.

Can you tell us what the Alabama legislature could have done differently to rid this state of illegal aliens and been within the law since you think HB 56 is wrong?

The national power in Washington, (democrats, republicans, and other species of politicians/bureaucrats), dishonors constitution law, and will not enforce federal rule and regulations of America's immigration policy. Alabama is trying to help the feds enforce illegal alien policy, and honor our Constitution. Apparently, Alabama and its HB56, are too simple, and needs to be more complex. The national feds needs to welcome our proud state of Alabama, Arizona, and any other state of the U.S., as partners in preventing illegal alien traffic across our borders.

I just feel like there should be a better balance, or a different solution somewhere. It is absolutely true that they should not be here illegally; however I do know the American farmers are suffering because they cannot get the average American to put in the manual labor for the wages they pay to harvest their crops. There are jobs that are lost to Mexicans, but there are also jobs that they will do that nobody else will. Maybe we should make it easier for them to get work visas, or maybe they should get some form of identification that would require them to pay taxes for their wages. Perhaps we shouldn't make the children born in the US to illegal aliens automatic citizens. Then they can all be deported as a family. Does anyone have a good solution? I haven't heard any yet.

Thomas E. - Other than to have the US annex Mexico and call it a State, I have not given the subject much consideration at all, really. Which, is why your assumption that I "think HB 56 is wrong" is not an accurate assumption. My concern over the broad topic as it relates to Alabama, has more to do with the use of State funds in spearheading a fight against the Feds (at this time) than it does..."what the Alabama legislature could have done differently to rid this state of illegal aliens and been within the law"...

It's messed up that the US would grant citizenship to babies born to illegals. What were they thinking when this law was established? If the parents are not suppose to be here who do they think is to take care of their children? These kids are in a "damned if you do and damned if you don't" situation. Citizenship should have never been given to a child since they have no way of providing for themselves. That was so messed up. Now we have a situation where family's are worried about being torn apart. On the other hand had the parents of these children used any common sense rather than trying to use their children as anchors this wouldn't be happening either. What's done is done but the law should be revised to state that illegal parents can not give birth to a US citizen. The parents wanted their children to be citizens and now they have that. I wonder if they have ever heard of " be careful what you wish for, you might get it"? Well their wishes have come true. Their should be no reason that a parent not be allowed to carry their children with them where ever they wish to live. These people worried about being seperated from their family's should pack them up and take them with them. If the child is old enough to have a voice and understand what it would mean to be left with friends or family and wishes to do stay then there shoudl be a provision made for them. They are not responsible for the sins of the parents. Some where there has to be a soluition to this without the US rolling over and playing dead. Some where there has to be a stance for the law or the law should be revoked. It's a situation that if you don't mean it don't pass it. Why waste the paper, time and expense to make bogus laws? Wouldn't that time been better spent on laws that would be upheld? What a waste of time that has turned into more time to be wasted.

These farmers are NOT paying minimum wage. Which is mandatory when you hire a U.S. Citizen, they pay these Hulio's under the table to avoid paying SS & FICA taxes. Thousands of people right here in Morgan County do more manuel labor at their jobs than the Hulio's did in the strawberry patches. These farmers ride around in air Conditioned Tractors w/ radio, GPS, and TV, and go into town driving a $50,000.00 Dually.... yeah i'll say there suffering. When the Farmers start paying decent wages by the hour instead of by the basket... people WILL work. If GM were paying their employees $100.00 a day for 12-15 hours of labor with no Taxes, how many people would be lined up trying to go to work for them???? Probably NONE. The Moral of the story is .... If you want good, reliable workers.... You have to pay a decent wage !!!!

The US is founded upon freedom. Simple, isn't. The freedom for you to think my brains are between my arse, is the same freedom that protects other from unequal treatment. In Alabama that is the norm. That is the issue with this state. But what do I know, I haven't a brain.

The law is the law alright; it is now obvious that the law is also a stupid law and will likely end up costing all of us in the form of increased utilities costs.

Some of you people are so prejudice, it is ridiculous. When speaking about "Illegals" why is it that you people say " them Mexicans". There are more "illegal aliens" that are Canadian, African, Asian, Guatamalan, Dominican Republic, Cuban, Puerto Rican, Russian, etc. than Mexican. Yes, we have a problem that needs a well thought out solution. If we are going to treat illegal aliens in this manner because they have "committed a crime" then are we going to treat "all criminals" in the same manner. Our jails would not have utilities, running water, TV's, weight rooms, 3 meals a day and etc...... This wonderful country of ours needs to find a way that benefits everyone involved. These people want an opportunity to live a good life, like the rest of us and they are willing to work for it. There just needs to be a way that is not so difficult, drawn out and cost an arm and a leg to do so. Let the illegals file for work Visa's (which needs an easier process), pay/file taxes for an X number of years and if they remain in good standing (no criminal records, pay bills, pay for medical /auto insurance, etc.), they can make application for permanent residency. As far as children born in the U.S that are from non-resident aliens, the parents must make application for them to live here permanent as well, as long as the parents follow proper processes and remain in good standing. If the parents are not allowed to live here any longer, the children must follow suit unless they are of legal age to file on their own merits. Just ideas.....

It takes 6 times the number of American workers to produce what 4 Hispanics can in a day, that's providing you can keep the American worker there for the whole day. The average American can make $265 a week just sitting at home drawing unemployment, where 40 hours @$7.25 brings in $290. Do you honestly think they are going to break their backs in the field for $290 a week? Where's the incentive? It's no wonder farmers would rather have Hispanics working their fields. They work harder and are more reliable because they haven't had everything handed to them their whole life.

As far as the farmer's riding around in their "air conditioned" tractors and driving Dually trucks....are you saying that they, as business owners are not allowed to profit from their business? That they are not allowed to work in air conditioning in the heat, as would the average Executive who sits behind a desk in air conditioned splendor and driving his BMW back and forth to work? Does the farmer not earn his wages any more than that Executive office worker?

I think you should be more concerned with the Americans that have gold around their necks, gold in their teeth and parking their new Lexus next to their government subsidized housing while taking advantage of the welfare system. My point being there are more problems with America that need fixing other than illegal immigration. However, that seems to be our focus at this time.

To all of you stating that ALL illegals are Mexican, do your research, they are coming in from Guatemala, Honduras, Domincan Republic...etc... you just can't categorize every Hispanic looking person as a Mexican. I agree with Russell P and A...Also I never heard of anyone turning away all the English, Irish, Italian...etc back in the days...
