MONTGOMERY (AP) — The state moved today to shut down four casinos it maintains are operating illegally in Alabama, filing suit to close three Indian gambling centers and seizing machines and cash from VictoryLand.
Attorney General Luther Strange's office filed suit against the Poarch Band of Creek Indians to close their casinos in Atmore, Montgomery and Wetumpka.
State troopers, meanwhile, served a search warrant with the aim of closing VictoryLand, located in Shorter in Macon County.
A statement from Strange said VictoryLand was operating in "open defiance" of laws against gambling.
"From my first day in office, I have worked to ensure that illegal gambling laws are enforced consistently across the state," Strange said in a statement.
Officials with the Poarch Band didn't immediately return calls seeking comment.
A lawyer for VictoryLand owner Milton McGregor, Joe Espy, said no court has ever ruled that the machines at the east Alabama attraction are illegal.
"No matter how one feels about legal gaming, this is a sad day for Alabama," Espy said in a statement. He called the lawsuit against the Poarch Band casino "a smokescreen and a waste of taxpayer money" since the state lacks control of Indian gambling.
The moves were the latest in the state's long-running effort to shut down what it contends are illegal gambling operations.
Both the tribal group and VictoryLand operators have contended their machines are legal.
The lawsuit over the Poach Band casinos, filed in Elmore County, asked a court to stop the use of illegal slot machines at the group's Wind Creek Casino in Atmore; the Creek Casino in Montgomery; and the Creek Casino in Wetumpka.
Federal law doesn't allow state police to enforce state law on Indian lands, but the lawsuit said the Poarch Band cannot operate slot machines or lotteries that are illegal everywhere else in Alabama.
State troopers blocked the entrance to VictoryLand, which was closed but reopened in December after federal jurors last year acquitted McGregor and others in an alleged Statehouse bribery scheme. Strange said officers seized several hundred gambling machines and cash.
The state will ask a Macon County court to make the owners forfeit the machines and money to the state, Strange's office said.

We all knew it before the election, Luther Strange is a crackpot! He says he has a God-Given legitimacy to flaunt the laws of this domocracy and make his own laws. I don't think he realy believes it. I believe he wears 'holiness' like a cheap huckster's jacket containing hidden pockets and elastic strings used to confound the ignorant. He's just another crooked politician.

I see the holier than though are striking again! Once we're dead broke the state would be glad to see that tax revenue and possibly start a state Lottery. Maybe the State should close and block all "Alabama" public roads 25 ft outside the Indian "Federal" land. No way to get in or out.

I hate that it would cost Alabama more money, but I would love to see this administration have to pay out the @$$ for hassling these casinos. They are not bothering anyone, I have heard of very little, if any, crime happening at them, and if they are paying taxes, then it is a win/win situation. They are keeping people employeed, lots of people, and I have not heard of anything illegal going on...such as tax evasion, etc.
So they are the only ones operating in a state that prohibits casinos. Big deal, they are Federal Land. I am keeping my fingers crossed that some judge will stick it to the decision makers!!!

Some of you need to try to get outside of your bias and political views for a second. Gambling is illegal in Alabama, thus the law must be followed whether you like it or not. That means if VictoryLand is using rewarding patrons with money won by gambling machines, they are in violation of the law. As far as the comments about "republicans" and "holier than thous", I suggest that you recall that voters in Alabama have had a handful of recent attempts to speak about gambling (the lottery) and each time it has failed. That is called a "democracy" for those that have forgotten what you learned in your high school American Government classes.
However, when it comes to Mr. Strange's justification for going after the Creek Indian casinos, I also suggest he remember how our system of government called federalism works. Those casinos are on federal land in which state law can't be enforced unless something that violates federal law is taking place. His reason that they are doing something illegal "everywhere else in Alabama" is a very, very thin argument considering that the legality of gambling is a state law, thus making it illegal everywhere in the state. Therefore, it can't be a law administered on federal land owned by Native Americans. Mr. Strange basically contradicts himself with the point he is trying to make. I predict a federal district judge making short work of his suit/
I have no words. Those of you who hate this state so much, the political spectrum and disagree with what we did to the Indians, then I suggest you become a non-citizen, find an Indian, give them everything you own and move to Bolivia. And yes, I am waiting for the sophomoric response to humor me even more. Wondering who will be the first one out of the gate to embarrass themselves even more than they have already. Anyone? Anyone? The hook and line is in the water.
"Gambling" is illegal? Really? Then what about all of the raffles held by school and civic organizations? What about the Dog Track in Mobile? What about the other North Alabama Indian Casinos or the hundrends of Bingo games going on every night across the State. Actually, Alabama's law regarding "gambling" is as convoluted as a conch shell. Apparently, these establishments are making too much money and not sharing with certain folks. What a crock.
Why is the State doing this??? This is an expense we can't afford now, and hundreds of people will loose their jobs. This is just plain stupidity, If you close these casino's people will cross state lines and spend their money there. Who is responsible for this??? I hope you will rethink this, it's a bad idea.
But if more people lose their jobs, they won't blame the republicans that caused it, in their minds it will be Obama's fault, just like everything else.
